I live in a double home with a single, long drive-way.  There are 4 vehicles all belonging to different people, we all have a set of each others keys.  Recently, a member of the family used my vehicle, due to it being the last one park in the driveway. Apparently just to go to the store, well unfortunately, he got a DWI while driving my car.  Is this considered stealing my vehicle, he is not covered under my insurance.  Please give me some information according to the law.  I live in NYS. Thank you.

   Since I don't live or work in New York I can't be specific about New York law.  However I would be surprised if the police charged your family member with stealing your car and I would also be surprised if the police would entertain a stolen car report from you.  If you are worried about your insurance you might talk to the police about New York's law concerning unauthorized use of an auto law.

   Sorry but it's really not my function here to look up laws in every state that I happen to get a question about.  I think that a simple way to handle this would be for you to call your local police department in New York and ask them the same question.

Ten years in patrol and sixteen years in the detective bureau investigating every type of crime including murder, rape, robbery, theft, fraud, missing persons, etc, etc. Also taught at the police academy in areas such as constitutional law, search and seizure, and lineups.
