Please do not ask me questions regarding possible terms of imprisonment. Further, if your question has to do with statutes of limitation, be aware that if you have been out of the state to avoid the charges, the statute will not apply. Finally, do not ask questions such as "I want to make a will for my kids, can you write it and email it to me" I can answer any questions regarding the criminal justice system, from arrest all the way through appeals, and for that matter, many other generic legal issues as well.

I am currently a criminal defense attorney. I have approximately 5 years of experience in both civil, constitutional, labor, and criminal law. I am a member of both the California and New York bars. I am currently an attorney for Johnny Cochran's criminal defense firm.
I worked for the Legal Aid Society of New York City. I worked for the NY Civil Liberties Union, and for the New York State Attorney General-Civil Rights Division.

Education/Credentials
I graduated Magna Cum Laude from the State Univ. of NY at Albany. I graduated from City University of NY School of Law in 2001, at near the top of my class. I passed both the NY and California bar exams on the first try, widely considered to be the most difficult exams in the nation.

Criminal Law - 15 yr old warrant!!

Question
I just received a phone call from an investigator that I have several criminal warrants issued for me from 1993!! At that time (I was very young and stupid) I took some money (not alot, but still awful) from a company I worked for. I am sure this is what these warrants are for (I've never been in any other trouble). Now 15 years later (I worked for them in 1991, I have no idea why they waited two years to file!) I am a Christian mother of three - and I find this out! I have never hidden my address from anyone and this is the first I have ever heard about this!! All of my tax returns have been on time (showing my current address), etc. Basically PG County MD is just so backlogged that they are just now getting around to this warrant, I guess. It seems TERRIBLY UNFAIR that I have to face this NOW after so much time has passed. There should be a law for a time frame. What should I do? What can I do?

Michele:
well, the first thing i suggest you do is hire an attorney.  All the free legal advice in the world won't really help you.  Your attorney needs to go in, remove the warrants, and put your case back on the court's calendar.  When he does that, the state must prosecute the case like any other.  
Now, they will probably have a hard time prosecuting this case because the evidence is very old, witnesses have probably disapeared, etc.  If they really are just getting around to your warrants now (which is doubtful), you may have  a delayed prosecution defense to use.  Again, this is all in theory, you must have an attorney go in and do the work.
I frequently get questions such as, "my son was arrested for rape, what should i do." That's the same as calling a doctor and saying, "i have cancer, tell me how to fix it".  It doesn't really help...Find yourself an attorney who you trust, and this should be easily resolved.
