Thank you for taking the time to write me on your situation involving your husband and his upcoming court date on the third degree felony.
As you are aware, I am not a licensed attorney, nor would I EVER have the desire to do so! There are so many people out there that I can hire if I decide that my mouth can not clearly state my position!
So with that disclaimer, let me tell you that the information that I am going to provide to you applies in Texas. The laws are different based on where you live, but this will give you an idea!
First, All criminal offenses are classified as either a felony offense or a misdemeanor offense. Of the two, felony crimes are much more serious offenses, usually resulting in severe legal penalties that may include life in prison. Unlike misdemeanors, felonies are broken down into several degrees as follows: (1) State Jail felonies; (2) Third-Degree felonies; (3) Second-Degree felonies; (4) First-Degree felonies; and (4) Capital felonies.
Some examples of crimes that ar considered felonies are:
Aggravated Crimes
Assault with a Deadly Weapon
Crimes Against Public Servants
Intoxication Manslaughter
Intoxication Assault
Kidnapping
Injury to a Child
Unlawful Restraint
Burglary of Habitation

PUNISHMENT RANGE FOR FELONIES IN TEXAS –
Common penalties for a felony crime include probation, excessive fines, community service, state jail or prison time, restitution to victims, counseling or treatment, and a serious mark on your permanent criminal record. Texas provides the following range of punishment for felony offenses:
State Jail Felony – If you are convicted of a State Jail felony, the punishment range is from 180 days to 2 years in a state jail facility and a fine up to $10,000. Unlike county jail and prison, you will not receive any credit for time served in a state jail facility, meaning you will serve day for day. To avoid this enhanced punishment, it is in your best interest to contact the Houston felony crime attorneys of The Westbrook Firm immediately. Capital Felony – Capital felonies are the most heinous of all crimes, including capital murder and aggravated sexual assault with enhancing facts. A conviction for one of these crimes will either be life in prison or death.
