Dear Mr. Paisola, I have a friend who is above the age of 18 who needs some advice. He and another person are planning on robbing a store. possibly a 7-11 type store. Guns could be involved. We all live in Maryland. If they are caught, what is the maximum and minimum punishment they can receive. Criminal Law - Domestic Battery in Florida, Robert Paisola Responds

Question In Florida in 1993 I was arrested for domestic battery after having and altercation with my 16yr old step-son, I was ordered to attend group counseling and given one years probation which required me to pay monthly fees. I moved later that year to Ohio and continued to pay my fees until complete but failed to continue with counseling, now 15years later I was pulled over at dui checkpoint and informed after running my license plate number that in july of this year a misdemeanor warrant was issued for me but that they could not arrest me as it was for Florida only. I`m not sure what to do at this point
Thank you for taking the time to write to me about your issue of your arrest in Florida on the charge of domestic violence.
As I am sure that you are aware, I am not licensed to practice law or give legal advice, so understand that the information that I am about to provide is based on my own experiences with clients around the world.
If you were ordered to attend counseling as a part of a court judgment against you, that means that you MUST finish the program successfully. Your failure to do so, means that the court, at any time can issue a warrant for your arrest.
Now, there are certain situations where you are not able or even willing to finish the counseling. One case that I covered for CNN I Report was about a girl who was ordered to attend a program called ODYSSEY HOUSE as part of her sanction. However, once she became active in the program, she was the victim of sexual abuse by her therapist.
Be sure to listen to the phone calls involved in this mess.
So what you need to do is to immediately contact the court that ordered you to do the therapy. Let them know that there were extenuating circumstances in 1993 that did not allow you to finish the Court Ordered Counseling Program.
If you are PROACTIVE, and work with the court, then you will most likely be ok.... just remember, it has been many years snce you were order to goto treatment and I seriously doubt that they even have your paperwork anymore.
You also may want to look at the Statute of Limitations for Florida.
