Question In North Carolina are the police allowed to breathalize a minor without parents present, and while on posted private property?

Thank you for taking the time to write to me about the issue of whether or not police can give a child a breathalyser test.
Let me tell you this, I am not an attorney, as my profile indicates, I simply hire them, however, If someone tried to give my child a breathalyser test without my consent, then all hell would break loose.
My guess is that unless this was done at school, where the parents have provided express written consent, or unless you have a 16 year old teen who was drinking and driving, then this would be completely unacceptable.
Bottom Line... If your child was ordered to take the test and you were not there, then I would file suit so fast, that it would be on Oprah within a week.
