Question Dear Robert,
I have awaited your arrival back from vacation because I believe from your profile and such that you would be the most appropriate person to ask this/these complex question/questions. I would like to know what time limit an authority (Marion County)has to formally file charges and issue an arrest warrant after they have put a hold on some one from another jurisdiction in the state of Florida? The circumstances are my best friend (who has bi-polar disorder) that I love so very much bonded out of the Sumpter County jail on March 21, 2008 and then when he went back to retrieve his property on March 25, 2008, they arrested him for what they say was a warrant from Marion County, Florida (he was in Sumpter County at the time of this arrest) the problem is that there are no warrants issued from that county and there are only pending charges and no formal charges have been filed. According to the Sumpter County Booking office, there is a hold on him from Marion County, FL. What does this mean? I can’t even get any answers from his attorney or his office about how long they can hold him without charges being filed. It appears as though Sumpter County let him bond out by mistake and now we have spent $2,850.00 for his bond and now he is being held W/O Bond. We can’t even get a bond hearing in Marion County because there are no charges or warrants. By the way, when he was arrested on May 25, 2008 at the jail, he was in possession of marijuana that was placed in a bag that had cocaine in it so he is now charged with possession of marijuana, cocaine, and resisting arrest with violence. He did not resist arrest with violence, he is not a violent person and he does not have anything like that on his record. He is in enough trouble already and this is just an added piece of stuff to deal with. Do we have any recourse against the jail who released him by mistake for the money put out for the bond? I had called the booking clerk there My main question though is how long does Marion County have to file charges and hold him without doing so?
Any help or suggestions you could give me would be greatly appreciated. I have searched the Florida Statutes and I can’t find any concrete explainable answer.

Before we get started, I want to tell you that I am truly honored that you waited for my return to the site to address your question. I am glad that our replies are not only shaking up the industry, but we are creating change.

Now, as you know, I am not an attorney.. blah blah blah...
So, Marion County has a hold on your best friend without a warrant.
My understanding is that they can detain an inmate on what is called a 72 hour hold. If the charges are not brought forward, then they must release the inmate, as there are no grounds for holding him.
Now you stated that Sumpter County is holding him due to a hold from Marion County. This most likely means that there is a warrant out of Marrion County. You must call the court clerks office in Marrion County to see if this is true. If it is not, go to the court and get a release on the warrant that Sumpter County tells you is the reason for the hold (even though it does not exist)
Now, he also walked into a jail with drugs. Ahh, kinda bad.
So.. The bottom line is to take a deep breath and call the jail. Ask them to outline all of the reasons that he is being held. They will give you a list (valid or not) and then you go to work dealing with the different courts one by one, getting orders to revoke the possible warrants, you push court dates forward by talking to the Court, you request bail if possible and post it.
Will you get your money back that you spent on bail? Nope. It is a complete loss.
