Question Dear Mr. Paisola,
We've been very concerned in the past by both phone and email threats our bi-polar son has made towards us and other friends & family members to do us bodily harm or even kill us, when he's having a manic episode, which can last for days after which he apologizes & acts like nothing happened.
The other day, as he has often done before, he involved himself in our business, (as a favor?) and contacted the son (and his family) of one of the principles of a company we've made an investment with, because it's been taking so long for us to get our money out.
He threatened to do them all bodily harm, (might have even threatened to kill them) if the company doesn't pay us, (his parents) what they owe us right away.
We don't believe he would carry it out, because threats have been his MO for the last 20 years, (to get people to do what he wants them to) and he's never actually hurt anyone.
Our concerns are these . .
1. Is he subject to possible arrest for threatening emails and phone calls like he sometimes makes, especially ones threatening to kill or cause bodily harm?
He believes that charges could only be brought against him if he confronts someone in person with a weapon, or assaults them physically in some manner.
2. Since he used our phone this last time, (caller ID shows my name) does that endanger me with the law as well?

Answer Dear John,
I want to thank you for taking the time to write to me about the issues that your son is having in his life and you concern for your well being and protection.
This is a very difficult question for me to reply to, as we have an individual who is obviously mentally deficient, but at the same time he has used this deficiency as his MO for more than 20 years, which represents that he has "standardized" his methods of madness.
One thing that I will advise you, is that you must seek a court order called a protective order. This is an order that will make it illegal for him to contact you and if he does, he could go to jail.
I am sure that once the court hears the case, that he will highly restrict whom he can come in contact with and whom he can not.
You are experiencing the anxiety because a loved one is on the wrong path and what I want you to know is THIS IS NOT YOUR FAULT, AND YOU MUST PROTECT YOUR FAMILY AT ALL COSTS.
So, print this letter and go to the court, show this to them and ask to see a judge immediately.
