QUESTION: can you get house arrest for a charge that carries a mandatory sentence?

ANSWER: Tasha,

Your question lacks a lot of specificity but here is a shot. If the statute requires a mandatory sentence, such as committing a crime with a gun mandates a 2 year prison sentence. Then I would find it highly unlikely the court would impose a house arrest.  There would have to be some extraordinary circumstance.

In my part of the country we don't have house arrest.  It is either probation or jail.  I don't know what is available in your part of the country.  Your best information would come from an attorney that is handling the case.  Could you get probation sure, it is a non violent crime, depending on history and the laws in your area it would be a possibility.
