Criminal Law/(Minor) P.I

Question
I have recently been charged for minor public intoxication. I claimed no contest but I really do not want the P.I. to go on my record. Is there any way that I can plead to the court, like maybe through a Deferred Adjudication or something?

Answer
Tiera,

Depends on where you are at in the court procedure and more importantly what is allowed in your courts.  If you haven't pled yet you can always approach the prosecutor or court for some sort of deferred status.  Again depends on what is allowed in your courts.  If you have already pled and the plea has been accepted by the court now you have to get the plea reversed ( not easy) and then enter a new agreement, deal , plea with the court/prosecutor.  For this step you would probably be best off consulting with a competent attorney in the area.  Last choice would be to check into an expungement.  However just so you are aware a person with a MIP is not that unusual and accept for the most restrictive professions it is really not much of a problem.

Hope this helped.
