Question this is gus i wanted to ask you what class is retail theft in, for example; class A, class B, class C and so on. i got charged retail theft for stealing 3 cd's from Best Buy and its my second offense so i was wondering what do you think will happen to me or what happens to most kids in this situation with fine and community service wise. Or what the judge can do to me, just let me know what you know please and thanks
Answer Gus,
Each State has different laws and penalties and terminology. For example in Michigan there is no Class of felony. We have different types of misdemeanors. Generally speaking retail theft is unfortunately fairly common and not considered serious. Depending on how recent your prior offense was I would not expect jail. Possible probation, fines and cost. The judge can do anything that is allowed under statute but is restricted by guidelines within your state based on history. It may be worth your while to schedule a visit with a local attorney competent to practice criminal law in your town. They can give you a real good feeling for what is normal in your county for this type of thing. You don't have to hire them to represent you just 30 minutes of their time.
