Expert: Robin Sexton Date: 7/3/2008 Subject: writing bad checks in Arizona
Question My 24 yr old daughter wrote many checks to various stores in Arizona that she knew were not good checks, it totals over $500.00, is this a Felony? and if so will they put a warrant out for her or will we get advised of it first from the courts??
Answer Kim,
Sorry about your daughters problems. I did a quick check it appears that this could be a felony. They are not required to give advance notice of an arrest warrant some agencies investigators due our of courtesy. The other issue is civilly the fees and penalties could double the amount owed. Best advise is to try and get the checks paid off as soon as possible and also seek the assistance of a competent attorney. The good news is that if your daughter is a first time offender she would be in good position for a deferred type sentence or limited probation. The aspect of any jail would be slight.
