Criminal Law - Public Defender Violated My Right to Trial....

Expert: Robin Sexton - 11/2/2009

Question
Can I sue the public defender's office in alexandria, virginia after I wrote letters to the atty to help me go to trial and she said no.... I am only to process you through the court system, but I cannot defend you.... Even my friends wrote her a letter and talked to her... not to force me to sign to papers.... but she ignored them.... Can I sue her, if so... where do i start...

Answer
Willie,

Sorry about the problem you are having.  To sue an attorney you will need to find an attorney willing to take on the case.  Trying to sue an attorney without an attorney would be foolish.  Secondly you need to be very cautious that any attorney you hire is really interested in the case and not just going to take your money.  You may be better off contacting the attorney grievance board for your state.   They will investigate based on the ethics rules in place in your state.

Hope this helps
