Criminal Law - appeal

Expert: Robin Sexton - 11/3/2009

Question
In Tennessee, I know you have 30 days to appeal a sentence. What if you go past the 30 days and you now want to do something about an unfair and unjust sentence. What are your options, if any?

Answer
Linda,

Each state will have differing rules on this and there sometimes extenuating circumstances that you can avail yourself of.  The only step that would have much chance of success is for you to contact private counsel and have them review the case, sentencing and other factors to determine if there is grounds to file a motion with the court.  It needs to be done quickly.  The longer you take the less likely you are to prevail.

Good luck
