Question
my husbands on parole and his discharge date is june 22 2009 he recently got arrested before his discharge date for spousal abuse he has a parole hold with no bail through parole but through the criminal case on the spousal his bail is set at 20,000 so i wanted to know can the hold be lifted from parole so he can bail out or can they violate him and keep him on parole another 5 years

Answer
Sasha,

Sorry about the problems your husband is having.  The parole hold is placed by the parole agent / agency and will remain until they lift it.  Even if the criminal charge is dropped or dismissed the parole hold can still be continued.  Parolee's are basically prisoners not inside prison so their freedom is at the discretion of the parole agency.  They have few rights.  If your husband is convicted of the abuse charge this would normally be added to his current sentence ( consecutive).  Automatic violation and probable return to prison for a period time.  Either the remainder of his current sentence or less. I would have no way of knowing without a great deal more information.  If the charge is dropped or dismissed the parole agency could still amend his parole agreement, extending, or even withdrawing at their discretion.
Your husband should be entitled to an attorney and they should be able to provide more specific information based on your husband case facts.

Good luck
