Question
I was in an accident 11-15-08.While at scene an officer asked me to do breath test while still in vehicle and emt trying to get me out,I refused but agreed to let them take blood at hospital.I was transfeered to next state with severe injuries to hand and kept in hosoital for a month.Once released I stayed there for six months going back and forth to Dr. and therapy.I came back to Iowa and was pulled over in a friends car with expired tags and took to jail for failure to appear on third offense D.U.I. I never was read rights or arrested. My first charge was ten years ago and five years ago.My question is they offered second with four months in treatment and two years probation.I have not recieved disability yet and am unable to use hand. If I left state after convicted would they likely come get me several states away?

Answer
Randy,

Sorry about the accident and the injuries, hope things improve for you.  You are asking some questions that can not be answered in this type of forum due to lack of a lot of information and ethics.  First I can not advise you as to any pleadings as i am not an attorney.  This is a matter that should be discussed with your attorney.  Also the question as to if the state will extradite you back is also not a question that I or anyone else in this forum could answer.  These decisions are based on the local prosecutor and more times then not are based on that jurisdiction current financial situation.  One thing that i do know If you enter a plea to four months treatment and 2 years probation, if you violate that agreement you could spend 2 or more years in jail.  Also some courts may allow you to transfer the probation to the jurisdiction you live in.

Sorry i could not be more helpful

Good luck
