Question
a complaint was filed against me by the DA. I was arrested and released the next day and since went to court but on my court date nothing was filed. It happened on 3/13/08 then recently i recieved a letter by the DA saying a complaint has been filed against me and i have to appear in court on 8/27/09. I want to know if there is a statue of limitations. The violation was for PC496(a) recieving stolen property, HS11377(a) possession of a controlled substance. I live in Johnson Valley California.

Answer
Kathy,

The statute of limitations varies from  state to state however the minimum that i am aware of is about 1 year for simple misdemeanors and they go up based on the seriousness of the crime.  So in the offences you mentioned I i don't know if they are misdemeanor of felony) the minimum would be 1 year at least.

Hope this helped
