what is the statue of limitations for a theft <$50 case with prior conviction?

First the prior conviction variable is not a factor in the statutes of limitations.
Second,  each state is different so you would have to check your states laws regarding that.  
Third, there are many different types of theft's.  Each has it's own variables, classifications and sentences.

However,  generally in most situations stealing less then $50.00 is a misdemeanor.  In most states the statute of limitations is one year.  Incidents longer then that most police agencies and prosecutors don't have the time or inclination to pursue.
