Criminal Law - warrents out of state

Expert: Robin Sexton - 7/3/2009

Question
if you have a warrant in Pennsylvania and get picked up in new York and you sign a wavier how long can new York hold you.

Answer
Flroine,

There is no set answer to this question and it is a very common question. It depends on several factors, the first and most important is what the court where the person is in custody at says.  After that the determining factor is how long the agency that is holding the person is willing to hold them.  Then the next is how long the requesting agency needs to get organized and get there or arrange for transportation.  None of this is defined by statute since the states have to mesh their separate needs and varying distances.
Best source of information is either the court or the agency that is holding the person.

Sorry I can't be more specific

Robin
