Hello, in August 2006 my daughter sold a kitten for $275.00 the person paid with a check, a couple of weeks ago ( July 2009 ) a police officer and a detective showed up at her door saying that she cashed a stolen check back in 2006, her signature is on the back, but I think they think she stole it and forged it, they told her she should get a hand writing specialist to prove her innocent, what kind of charges can she get, is there a statute of limitation on this, will she have to pay the bank that she cashed the check their money back with interest and penalty, she doesn't have the money to get an expert hand writing analysis nor does she have the money to get an attorney, she lives in Ohio if that makes any differences. any information would be greatly appreciated. thank you, Patti

In the United States a person is considered innocent until proven guilty. It is the burden of the prosecution to prove your daughter's guilt beyond a reasonable doubt and not the other way around. Regardless, because the police are accusing her it might be very wise to contact a criminal defense attorney in your daughter's area and ask for a free consultation to see exactly what she might be up against. In most jurisdictions the crimes of forgery and uttering are low level felonies. In short, very serious offenses that require the services of a professional.
