You sent this question twice so i will only respond to this one.

The answer unfortunately for you is "both".  All criminal violations have a parallel civil issue.  In your example the criminal possibilities are assault, and criminal civil rights violations, and some other related crimes.  Civilly you have the same assault and civil criminal rights violations. The criminal charges zeroes in on the criminal culpability of the individual officer the civil is broader in scope possibly including the entire department and other entities.
