Question
Does a subpoena to a witness in a criminal case have to be hand (personally) delivered or can it be stuck in a door?Can it be mailed to the potential witness?

Answer
It depends on the law in your state.  As you know there are fifty states with fifty sets of laws so the law varies from state to state.  I can tell you this.  In MY state a legal service of a subpoena is one that is either handed or left with the person named.  However 99% of subpoenas are mailed and judges have been known to send out the sheriff to round up people who refuse to come to court.  Again....this applies to MY state.

I am a retired police officer with 26 years experience. I investigated almost every type of crime including murder, rape, theft, missing persons, fraud, and domestic abuse. I am very knowledgeable about search and seizure and taught at the police academy for several years on a variety of subjects. I can answer questions that a lot of attorneys cannot since they do not have "street experience".
