Question
i have a friend who had been placed on deferred adjudicated probation 7 yrs ago in texas. it was to last 3 yrs 2 of which unsupervised. first offense no prior record. they violated by leaving 2 weeks into it. They have since moved to alabama has a family child in school. they've wanted to turn themselves in but afraid of the 2yr max term that could be imposed what is the likely hood of prison time

Answer
Jane,

I regret that it is impossible for me or anyone else in this type of forum to answer that question.  The variables are just to great.  My best suggestion is to contact an attorney in the area of the court where the charge was.  Have them check into it.  If they are experienced in the criminal court in that area they can give you a rough idea what the repercussions may be.  One other aspect is that it is very possible that the court issued a warrant for this person.  If it is classified as a felony they could be subject to arrest and extradition in Alabama.

Good luck
