Dear Mr. Paisola, I have a friend who is above the age of 18 who needs some advice. He and another person are planning on robbing a store. possibly a 7-11 type store. Guns could be involved. We all live in Maryland. If they are caught, what is the maximum and minimum punishment they can receive. Question Hi. I live in Florida and my husband is currently serving time in a Louisiana DOC correctional facility. Winn Correctional Facility to be exact. He's been incarcerated on a Violation of Parole charge for abscounding since April 19, 2006 and is scheduled for full term release in January 2008. He has 3 detainers on him for Forgery Warrants. Check forgery, one is for a $627 in Bossier City, LA and the other two warrants (in Franklin Parish) are for various checks not more than $200. One warrant has 4 checks and the other is for 2 checks I think. Bossier City won't arrest him and charge him until he is done with his time he's serving now for VOP in January. What can we do to push this or can we take care of this by paying restitution in advance? We have an attorney but the attorney isn't getting anywhere with this either since Bossier City says it's not in their procedures to arrest a person who is currently incarcerated. My main concern is, he's already spent a year and a half in prison, almost 2 by the time he gets out. How much longer can he serve with these other charges? This will be his 3rd time conviction too. So I'm really worried. We're newlyweds and I just want my husband to be able to come home. Before he met me, he didn't have anyone, so to him it didn't matter if he did right or wrong. But now that he has me, he just wants to do right and come home. (I'm sure you hear this a lot). But having someone that loves you no matter what you've done and doesn't judge you. It makes a difference in a persons life. I just want my husband and I to have a life, outside of prison. Also he's been treated unjustly since he's been incarcerated. The facility he's at has had MRSA outbreaks and Jeremy has scars from his outbreaks. They didn't treat him for it. He ended up drinking bleach water and that killed everything in his system. He has applied 14 times to become a trustee and has been denied even though he's never been in any kind of trouble. And other inmates with multiple write up and sex charges are trustees, even trustees that are allowed outside the gates of the facility. He has multiple degrees and is an ASE Certified Master Mechanic and even a licensed Ferrier as well as a degree as a Vet Tech. But can't get a job there in the shop or in the horse barn. He just wanted to put his skills to use. They won't let him teach because he also has degrees in computer networking and multiple computer certifications so they view him as a security risk. Jeremy wants to be transferred out of that facility and into another one where he can better himself. What can I do to push this issue? I guess I have a lot of questions. I just need someone to talk to. Someone that is there for us that won't judge either of us. Also if you have anyone else that just needs someone to talk to. They don't have to be local to Florida or Louisiana. Can you give them my e-mail. I had a support group in the beginning but they've since diminished and with facing more time, I need someone to talk to also. Hello Laurie,
First of all I want to thank you for being strong as your husband serves his time at the Louisiana Department of Corrections at Wynn Correctional Facility.
Your husband has a mandatory release date of Jamuary 2008, and that will take care of his obligations to the State for the Violation of Parole.
His case manager can provide him with a breakdown of all of the warrants and detainers that he has on him. WHILE IN CUSTODY he needs to contact the courts that have placed detainers against him to simply dismiss the pending charges in the interests of justice, as he is in custody.
Give me a check to see if I can find a detainer removal letter.
OK- What he needs to do is to send the letter and reference the following:
Interstate Agreement on Detainers (IAD) – (Inmate Request for Disposition) If the inmate agrees to return, a. The inmate must inform the facility records manager in writing of his/her intention to return to that jurisdiction for prosecution. b. The facility records manager will then issue forms II, III and IV of the agreement tothe prosecuting agency. These forms will be sent by certified mail to the prosecuting agency. The certified mail documentation shall be maintained in the inmate’s file. c. The prosecuting agency then has 180 days from receipt of the forms in which to pickup the inmate and return him/her to that jurisdiction for prosecution. The inmate must be returned after sentencing. If the inmate does not take action to demand disposition of the charges: a. The detaining agency may request temporary custody by issuing form V, Request for Temporary Custody. b. The facility records manager will then issue a letter to the Governor of the State of New Mexico along with Form III, the Certificate of Inmate’s Status and the detainer. The letter will indicate the prosecuting state’s interest in prosecuting the inmate. c. The Governor will have 30 days in which to grant temporary custody or take noaction. d. If no response is received, an Advisement of Rights hearing will be scheduled. The facility records manager is responsible for coordinating this hearing with the local District Attorney’s office. The courts will then issue an order determining the next course of action.
One thing that I can tell is that you are truly sincere in your desire to assist him.
If you want him to get a good job or to be transfered to another less harsh institution, YOU HAVE TO BE THE VOICE.
Now, the rest of my letter is to Jeremy,
Jeremy, take this to your case manager and tell them that this is what you want, you want the case manager to start the process under the interstate detainer act NOW.
Of they fail to do this, let me know and we will go live on our site.
To the case manager, please help him. We want this to go away and do not want to involve the Governors Office in LA.
Please do the right thing for him.
