Dear Mr. Paisola, I have a friend who is above the age of 18 who needs some advice. He and another person are planning on robbing a store. possibly a 7-11 type store. Guns could be involved. We all live in Maryland. If they are caught, what is the maximum and minimum punishment they can receive. Question My brother was on level 3 probation (no felonies or drug charges) and received a knock at the door one night at 11:15pm from a PO other than his own (not a supervisor) accompanied by about 5 to 6 state police officers. Noted by the reporting officer in the initial criminal report, they were there for a "routine administrative check", explained to my brother by the PO as a curfew check to make sure he was in fact home. Since my brother answered the door that should have satisfied their check. One of the police officers said that he smelled marijuana coming from inside and wanted to search the place. The reporting officer wrote that they decided to do an administrative search and that the PO discovered drugs in the basement and then called upon him for assistance. What really happened was the PO sat down on the couch beside my parents and talked with them the entire time as the State police officers searched through my brother's room (understandably), woke my dad up and then searched my parent's room, the bathroom, the closets and then the basement, where my little brother sleeps. They searched the house for about an hour and then they called up to the PO and told him what they found and then he told my brother that if he didn't confess that they would take away my parents and my little brothers. The report says that the drugs were found in the basement, which is true, but the PO didn't even step foot down there. My brother did claim ownership of the drugs and was then taken to the police station. As noted, once he got there he was read his Miranda rights and then the arrest warrant was issued by a judge and then another warrant was issued for VOP by his PO's supervisor. He accepted a plea bargain of 24 mos mandatory level 5, followed by 6 mos level 4, 18 mos level 3 and a yr at level 2. It was also not taken into consideration that he has Cerebral Palsy and was assessed by A I Dupont to be at the borderline of mental retardation. He has already completed 11 mos of his time and has been in the Key program for the last 6 mos also. His condition is definitely worsening and I'm scared he won't be able to make it the rest of the way. In your opinion, is there anything that can be done to get him out early or to at least recognize his disability and make sure he is in the proper place to handle such. I apologize for the length and detail and appreciate your time.

First of all thank you for taking the time to write to me. I can tell that you really care for your brother, and that is why I am writing you now from South Africa.
Here is the problem that you have here. The reason that the Probation Officer was present is because in the Original Probation Order, it was stated that they could perform "routine inspections" of the residence as a condition of probation.
If an offender is under probation, this is a much used tactic to avoid the hassle of warrants to search, as the offender is obliged to permit a search.
Now, the fact that the PO sat on the couch and did nothing does not surprise me. He is just required to be there.
Now, your brothers mental condition is a really serious issue and what you should do is make daily contact with the prison doctor to ensure that he is getting his medications. GET A COMPLETE LIST OF ALL THE MEDS HE IS TAKING AND LOOK THEM UP ON WEBMD.COM Many times they will issue Thorazine or some other Haldol type drug to overmedicate the inmate to make him/her very passive and submissive.
You also need to get letters from his Mental Health Workers stating that he is being DAMAGED by being confined.
Once you do all of this then you can ask to see the judge and ask for a MODIFICATION OF SENTENCE and possibly get Home Confinement.
