Dear Mr. Paisola, I have a friend who is above the age of 18 who needs some advice. He and another person are planning on robbing a store. possibly a 7-11 type store. Guns could be involved. We all live in Maryland. If they are caught, what is the maximum and minimum punishment they can receive. Criminal Law - Violation of Civil Rights? Robert Paisola Responds

Question Mr. Paisola, My daughter is bipolar,post traumatic stress disorder, OCD. She has had a history of mental illness since birth. At 17 years old and after many psychiatric hospital stays, she stole someone credit card and money about $700 to buy an airplane to ticket to visit her friends and to buy clothing. I had her to return home and the D.A. charged her with 7 felons. Her public defender told her to plead guilty. Some other inmate told her to ask for youth offender status because of her first offense. The judge sealed her records put her on 7 year probation, kept her in county jail for 7 months, where she was maced (the guards held her head up and mace her) and kiced because she stopped-up the toilets. She was then forced to stripped naked where the male guards made fun of her. We complained and nothing was done. She was attending Georgetown University and her probation officer made her quit. She continue to violate my daughter for just about anything. Last December 21, 06, she was stopped by police and found to have a I.D. that said she was 21 years old and actually, she was going to be 21 in a few weeks, on Jan 23, 2007. She was sentenced to 1 to 3 years at Bedford Maximum Security Facility for 90 days. She was forced to have father, mother and a wife. She is under Kendra's Law (which I had to threaten Albany County with lawsuit under the Color of Law) which she is suppose to be provided housing and therapy. Our family moved from Albany to Dallas Texas in September, 07 and my daughter called telling me that she was thrown off the program (by lay people over the Judge's Order) and was homeless. We sent for her with the hopes that we could work something out with NYS Parole and Dallas Parole, to let her stay with us because she has no family in Albany. Dallas and the mental health people will allow her to stay but instead one of the NYS area parole managers, told the Dallas police to stop giving her medicine and put out a National Felony Warrant for Parole Violation (we sent for her because she was homeless and if she didn't get an address, she would be sent to back to Prison, according to her parole office). The NYS warrant was up this pass Friday and she was to be discharge from the Dallas Correctional facility but instead the Dallas Release Division re-booked her. When I asked who did this no one will tell me. I also found out that my daughter didn't know that she was rebooked. New York State sent two officers to pick her up but after her refusing to get dressed and speaking to me on the phone on how she came to be on Parole and why weren't they picking up another NYS Parole violator and just my daughter, they didn't give me an answer but left. The Magistrate told my daughter at her initial hearing that it is Texas Law to only hold an out-of -state offender for 10 days and if the other state doesn't show up, then they are to be released. NYS did not show back up and the NYS Warrant was lapsed after 5 days and my daughter is still in jail without her meds in a single still naked. What are her rights? I went to the FBI and they said they will investigate. I also want to know isn't her sentences "Cruel and Unusual Punishment? I believe that she is suffering these injustices because she is black and gay. What can I do? Texas says she doesn't have rights. Please advise, Char Marsh
