Hello,
I was wondering if you could tell me if there is a statute of limitations in missouri on dwi.
My husband was arrested in March of 2006. Our attorney said that the tickets were not in court on the first courtdate, in April. He says that means they are researching whether to charge as a felony (since it is not my husbands first one).
How long does the prosecutor have to file the charge? It's been 91 days now and our attorney still doesn't know whats going on with it! What is a fast and speedy trial?

    You have the term "statute of limitations" confused with the right to a speedy trial.  Statute of limitations means that the police have a certain amount of time to solve a case or to obtain a warrant for the suspect.  It has nothing to do with your situation however the constitutioal right to a speedy trial might.  Your attorney should know this and should know how to file the necessary motions.
