Question
I am trying to find information for a book I am writing. I am curious about what the possible punishment could be for a man aged in his 30's for participating in consentual sexual activities with a 17 year boy (almost 18) in a state with the age of consent at 18. Any information would be highly appreciated, as would any other resources with information on this subject.

Thank you in advance for any assistence.

Answer
THANK YOU FOR YOUR QUESTION.

Anyone under the age of 18 who consentually or not has intercourse with an adult can be charged with statutory rape. Possible punishment is determined by the accused criminal history record, the trial process and evidence and witnesses as well as the victims statements. It is classified as a felony and felonies are usually punishable by a year of more in a prison when the sentence is incarceration, other options include, probation instead.
