Question sir at 8:25 four friends and i were in route to a liquor store all but one of us are of age and we each had a beer(unopened) and i had 1 empty can in my possession we were walking through a parking lot when four police cars pulled up and three (what i assumed are trainees because they had fabric badges and no metal shields) and five normal police officers descended upon us and begin to accuse us of defacing public property after which we informed them we had done no such thing and further informed them we were on our way to the liquor store they then harassed us for thirty minutes and asked such degrading questions as "what are you all a bunch of raging alcoholics?" and "why do you losers hand out together" and then they approached a parked car and begin to investigate that car and ask us repeatedly and with a malicious demeaner "is this your car, is this your fucking car?" it was none of our car like i said we had been drinking so we were walking to the liquor store they then began to search all of us they found nothing however there was one female in our group who asked to be searched by a female officer and they refused i claim to be no expert of the law and yet somehow this doesn't seem right to me we all plead not guilty and are awaiting trial i was hoping you might be able to shed some light on the subject , see the judge informed me that trespassing is and i quote " a person commits the crime of first degree criminal trespass if such person knowingly and unlawfully enters or remains in a dwelling of another or if such person enter any motor vehicle with intent to commit a crime therein" we did not knowingly enter this area it wasnt fenced off and there were no signs furthermore after they wrote us all tickets mine being the only one with an "open container" they had us open our unopened beers and pour them out so although i did have an empty beer that hardly classifies as open container right please i hope you can explain this to me
sincerely
robert
Answer Robert,
I am not sure what your question is. It seems that you are complaining about the actions of the police. I'm not the person to talk to if you don't like what the police did. You need to speak to the supervisor of these officers if you feel that they violated departmental rules.
If you are asking about the law in your state that would difficult since there are fifty states with fifty sets of laws. Perhaps your attorney would be able to shed some light on your situation.
Please do not ask me about potential jail sentences that you, your friends, or family might receive in court. There is no way for me to know that. Only a judge could answer a question like that. I am also NOT a probation officer or parole officer so I cannot answer questions that relate to parole or probation. Also please keep in mind that every state has different laws. If you are planning to ask a question about a specific law or criminal charge that pertains to your state only it could be difficult to answer. I also cannot give you legal advice on what to do or what not to do in court.
Retired police officer with 26 years experience. Worked in the patrol
division as well as over 14 years in the detective bureau. Investigated a
wide range of crime such as murder, rape, robbery, theft, fraud, missing
persons, and other very sensitive crimes. I am available to answer your
questions about criminal law and especially as it applies to police work. I
taught at the police academy for several years and am especially
knowledgeable about search and seizure. Any question about criminal law is
welcome! Please don't ask me to do your homework or ask me questions that obviously come from your teachers or professors. I also do not do online interviews or surveys. Young people need to gain face to face interviewing skills. Local police officers usually are very agreeable to assist in these assignments.
Experience
I am a retired police officer with 26 years experience. I investigated almost every type of crime including murder, rape, theft, missing persons, fraud, and domestic abuse. I am very knowledgeable about search and seizure and taught at the police academy for several years on a variety of subjects. I can answer questions that a lot of attorneys cannot since they do not have "street experience".
