Question
my husband is now in custody for an accident that happenned in 2/05 he was making a turn on to a street when he was struck by a car that was going over the limit. The passenger(his best friend)died on the scene. My husband was rushed to the hospital and released that night. The lady in the other car was ok.My husband doesn't have a licence he is undocumented. My question to you is that considered vehicular manslaughter and how much time do you think he will be given? Who is pressing charges? Is this going to lead to a trial? Is he ok with a public defender or should we get an attorney

Answer
THANK YOU FOR YOUR QUESTION.

Charges in this case are pressed by the state attorney's office (the state). Usually the defendant in such cases awaits trial. Public defenders are ligitimate attorney's who can perform the same defense as paid attorney's it would be to your discretion to determine your satisfaction with this public defender. You may contact your local public defender's office for more information on his case and or the state attorney's office regarding the charges.
