Question I have a roommate, who is also my brother. He was served with a 30 day eviction notice by my landlord but says he will not move out that he "has rights". 2 weeks into the 30 days rent was due and he did not pay it, I had to make up the difference. What can I do ? I want him out! I need to know quickly what I can do and if he really can just stay.

You need to write me back after you answer the following questions.
Is your brother on the lease agreement?
Are you on the lease agreement?
What rights does your brother "think" he has?
Why did the landlord serve him an eviction notice in the first place?
Does the landlord intend to pursue the eviction by either having him served with an unlawful detainer or having an eviction service complete the eviction?
Will the landlord change out the locks after the 30 day period has expired?
You need to find the answer to all of these questions. PLUS you need to call or visit the Fair Housing Council in your city so they can tell you what your rights are, what your brothers rights are and what the landlords rights are. Take a copy of the lease agreement with you.
