You assumption is not correct.  If the prostitute has oral herpes, you can contract this disease.  There is a condition called asymptomatic shedding of the virus.  This means that if one has herpes they are constantly shedding the virus.  It is believed that 60-70% transmission is by asymptomatic shedding of the virus.
