Question
a co-worker who had surgery was pressured to come into work and train a new employee while she was on disability. She was paid off the books to do this and when she returned the employer asked her to send back her last disability check to the insurance company. Didn't he violate the law by having her come back to work? Does she have to return the last disability payment? Does she have any rights in this situation?

Didn't he violate the law by having her come back to work?

Yes, why do you think he was paying her under the table.

Does she have to return the last disability payment?

Yes, if she worked and was paid.

Does she have any rights in this situation?

Yes, depending the on the state she lives in. I would get an attorney.
