Disability Law - PTSD, depression, migraines

Expert: Kyla Kelim - 11/11/2008

Question
Hello - I have an exam tomorrow with a psychiatrist regarding the above mentioned disabilities.  I am currently rated at 50% for migraines & 50% for major depression with PTSD through the VA (recently won my claim for individual unemployability).  Does the SSA use the same critera for these disabilities?  I have been on disability with the VA since 2002 and unable to establish a stable work history since then -

Thank you for your help!

Answer
Tara, not necessarily but certainly its persuasive if you have already been found to be unemployable due to the conditions.  There must be adequate objective testing for the Social Security Administration to enter a finding that you are unable to work.

I hope this helps,

Kyla Kelim
