Question
My wife was on long term disability leave from her employer and received LTD benefits through an LTD insurance policy.  After 2 years on LTD benefits my wife was awarded SSDI benefits from SSA.  The insurance company providing the LTD coverage has recently contacted my wife and wants to be reimbursed the difference between her LTD benefits and the SSDI benefits she was awarded retroactively.  Is this legal?  My wife is a New York State resident.

Mike, yes, it is according to the contract.  I cannot speak to New York law, but this is a common contractual provision in long term disability insurance policies.  For more specific questions, you will need to contact a New York lawyer well versed in contract law.
