Question I am currently on permanent ltd. I received this benefit from my former employer. I have severe OA and torn menisci in both knees. I am also very overweight. I have 2 doctors that both corroborate my disability as permanent and lab testing as well. I require bilateral knee replacement. However both doctors want me to lose weight prior to the surgeries. In the meantime I have been asked to undergo physical therapy, drug therapy, exercise and injections. I have two questions:
1) My former employer is very successful and provided a comprehensive benefit plan for the entire staff. If he decides to change the company disability benefit or stops paying their premiums would my benfits be terminated or reduced? If so, what would I need to do?
2) I have followed most of the treatments plans that my doctors have recommended. However my medical insurance doesn't cover them entirely and I can't afford everything. Could I lose my coverage if I can't follow all the doctor's recommendations.

Answer Nita, 1) Disability insurance will continue to be paid according to the terms of the contract. 2) You might lose your coverage for failure to comply. Also, some insurance companies will not cover certain surgeries unless you follow a weight loss plan. I would consult with a local disability attorney for more specific answers and any additional protections that state law may offer you.
