Question I worked for the company for 6+ years. I got pregnant and was put on bed rest nearing the end of the pregancy for the sake of my unborn son. So my company put me on Short Term Disability. I received a letter from my company a few days before the birth of my son stating that I had been terminated. I have since filed for unemployment but now my company is stating that I quit and could not collect unemployment. I am already out looking for a job, but I need money in the meantime. What should my next steps be? I would have thought that at this point I was entitled to either FMLA or unemployment? How could they get away with this?
Answer Joanne, sounds like you need to run to an employment discrimination attorney, as the company is not allowed to terminate you for being pregnant. You are also protected by the FMLA for up to 12 weeks of unpaid leave. Your state may also provide enhanced benefits for you.
