Question I'm from Texas and i work at a bank, my Dr. gave me a note that allows me to park in a handicap space, because i had to park 4 blocks from the bank and i suffer from low pressure and it has been really difficult during my pregnancy to walk all the way to my work. I ask for the parking and they denied me the space. They told me if i want to park in the building i have to pay and that it was the bank's policy that they don't offer any kind of special parking spaces. Is that legal? Because I dont want to put on risk my baby life. Another thing I asked also for leave of absence without pay for 6 days, i already have been working 1 year with them, and they also gave me 2 days without a pay and 1 sick day, and that they cant give me more days, but I really have to take the full 6 days, is there any law that can tell me that I have the rights to ask for leave of absence for the complete 6 days?
Answer Angelica, it seems like you have a great case under the ADA (Americans with Disabilities Act) for their failure to give you a space without paying for it, and the FMLA (Family and Medical Leave Act), which gives you up to 12 weeks of unpaid leave once you have worked there for 12 months. Make SURE you have been there a year, and simply put in a request with your HR under the FMLA. It really sounds like you need to talk to a disabilities attorney already, since they seem to not want to follow the law they should certainly know about.
