Question
hi-
with mental conditions like social phobia-anxiety, major depression & schizoid personality, dose ssa provide disability support with allowance for limited employment income based on how much/little a person can work within their disability, how much is allowed per month?
before being diagnosed with personality disorder, i filed for social security disability last year and was denied, i didn't appeal.  i plan to re-file this year and if denied, i'll appeal. as part of filling an appeal, will ssa provide me with counsel once i request a hearing?

Answer
Jr, If you are approved, you may work a limited amount without social security deeming it a successful work attempt.  That amount will vary by year and will include your GROSS pay, so be careful.  It does not mean the amount you actually put in the bank each pay period.

You should refile as soon as possible.  If you refile within a year of your last claim, then if you are awarded social security, it is retroactive back to your first application date, which is what you want.  If you are denied, you must hire your own lawyer.  Social security lawyers work according to a strict fee agreement which social security provides, 25% of backpay, capped at $ 5,300.00 at present.

I hope this helps,

Kyla Kelim
