Disability Law - Is This Lady Disabled?

Expert: Barry N. Saunders - 4/2/2007

Question
I have a friend who is 80 years of age. She had to have her foot amputated a few years ago and wears a prosthesis. She is able to walk and her car is equipped with special pedals which allow her to drive. This courageous lady recently visited a doctor who informed her that she did not qualify to be "disabled." What could this doctor be thinking of? Is this lady disabled? Should she not be qualified to receive a disabled license plate and some of the other benifits designed to help people with disablilites?

Kate
Arizona

Answer
Dear Kate:

Because on attends Medical School and has M.D. after his name does not indicate in any manner his level of intelligence or competence. Ask him if can can get a refund from the medical school he attended.  After years of dealing with doctors within the VA and DoD systems I am an absolute expert on these types of quacks.

Have this dear lady seek out a new doctor that specializes in Geriatrics, has a brain, and is simply a decent caring human being. Of course, pretty much by law an 80 year old woman with one foot is by the most conservation definition disabled.

I pray that I am never in an accident or need emergency care at your local hospital and have this idiot as my doctor.  It would make a good Stephen King novel.

YES THIS LADY IS DISABLED! You heard it hear first folks, get her to an MD and her paperwork completed.

BARRY N. SAUNDERS, M.S., B.A., AAS

Yes, I have some alphabet soup after my name too.
