FTN Exporting official publication "International Trade and the Successful Intermediary"(ITSI) is about to be released world wide (December 2009) by the prestigious U.K publishing firm Gower's (U.K) and is listed on Amazon.com (Keyword: International Trade Intermediary) ITSI is ostensibly the first uniform intermediary trading doctrine of its kind, and will become the standard intermediary practice world wide in years to come. FTN exporting has created the said doctrine and supporting rules of trade defined as "URPIB" (Uniform Rules and Practice for Intermediaries and Brokers), which will (has?) become the most successful set of private intermediary rules ever created.

Distribution of Products - Have Buyer But in need of real seller....

Expert: Davide Andrew Papa - 5/30/2009

Question
Dear David,

Thanks in advance for your time and effort, I have the buyer ready to buy D2 for a contract 500,000 M/T x Month for 12 Months. Now the problem is that they are very skeptical about talking to intermediaries since they all have the product and in the end they don't have nothing and yet they say they have to check with their principals. Now How do I Get a real seller mandate that are willing to meet in person with us and that can show us that they are the real sellers and not others intermediaries I have the buyers mandate ready with all the documents and information just waiting for the right seller to come to us.
please advice...

Answer

Dear Raul

It's an ongoing process from the monment you get the offer until closing. It all starts with the offer- Bad start , bad deal-

They are trying to control the deal as buyer/seller- they are trying to do what you are supposesd to do-act as a "buyer/seller"

You have to force them to "step back " to you, in return you protect commissions- but that's not going to happen.

Now! How can I advise you on such matters that needs a great amount of study and practice to apply- I can't. You really need to know a lot when entering such complex deals.

You can only deal with other intermediaries who assist you to secure the end buyer is the most effective and safest protocol- You should only be dealing with goods from a " suppliers in possession of such" and not another "Seller"- But if you don't know procedures - You really cannot hold such a position anyway.

You HAVE to have Supplier verified without such you cannot accept another sellers offer-

If the '"Seller mandate " does not disclose their principal to you they are not a mandate holder of the principal, just another confused intermediary.

Like wise with the buyers claim of mandate ship- if he dose not reveal the end buyer Taking possession of goods - his position is falsely implied. If any of the mandate holders are asking for commission within the deal- then they are not mandate holders , as mandates holders get their commissiom from their disclosed principal.

You have to verify Supply all the way back to the supplier in possession of goods to be allowed to effectively make an offer to resell such goods as "seller' acting on behalf of an undisclosed principal- No verification..NO DEAL

Read www.itsi.itgo.com FAQ section.Read URPIB  the process is listed-but not categorized into formal procedures.

Hope above helps

Kind Regards
