Question
I married a illegal immigrant 13 years ago (we do have a child), but he was deported about 3 months into our marriage.  I have tried sending him divorce papers to the last known address I had for him, with never no reply.  Mind you he married me with his middle name, I found out about a year ago he may be married to someone in his country and I really don't care but I would like to divorce him and move on.  Neither my daughter or I have had no contact in the last 13 years with this man how do I divorce him?  (He was deported back to Costa Rica).  I have no other information on him but one address in his country, no telephone number no nothing, please help!

Hello Robin,
In the United States you can get a divorce with or without a response.
When you file for divorce,
1.Serve him the papers.
2.You need proof of service,(his signature, that he received the papers.)after that you do not need him to respond any further.You can continue the divorce without him.
3.If no response and you get an unable to deliver notice, you need to publish a notice in the local newspaper for a one or two week period.
After you publish and wait the mandatory time,you can then proceed with the divorce without him.
Be sure to look up your state family law section. The divorce packet will have detail instructions. Hope this helps,Sorry so late with response,
