Divorce Issues - Credit Cards

Expert: Equality in Marriage Institute - 6/15/2006

Question
I've been married only 9 months. I live in the state of Michigan.  We are getting a divorse and found out that she used a credit card that is only in my name.  Its kinda a debt, what happens is instead of getting a vacation check they place it into an account. They send me a new card with a different account every 6 months. We've always kept it out so if we need anything we can use it. My wife used it a few times the other day(she decided to go shopping). Can i do anything about that, is she responsible to pay me back. Is it illegal for her to use it since shes not on the card.

Answer
Dear Brandon,

Check out this article http://www.divorcenet.com/states/michigan/protecting_client_credit for information pertaining to Michigan.

While it is important for you to speak with you attorney about this you may find yourself footing the expense. The charges are to your credt card. You may be able to deduct the amount she charged on the card from any amount she is due from the marriage.

You will most likely want to close or cancel all credit cards that you currently share and open up new accounts under your name only.
