Question I live in Salem, MA married for 3 years.
I am currently considering divorcing my wife she immigrant and she will probably will her green card within the next month. Our relationship has been destroyed because I found out she going out with someone else. And exchanging sex emails on her email box, very depressing
now she told me not to divorce her until she gets her green card.I said I can't wait until then, she already kicked me out of the house. it has been 2 weeks since the move out. and I am going for divorce this time. I currently own a business sole proprietorship. the business has only 9 months and everything is losses no profit yet, paying out of pocket. the business owe $5000 in credit card payment. would she be deported immediately if we divorce in court, what are her rights in term of money in this situation.

Because your business is fairly young and only in your name? you may not have to share future interest in the company with your soon to be ex. For the fastest answer you should speak with a qualified attorney in your area. You can also find laws surrounding marriage and divorce at your state's legislative website. Use google and search under "name of your state + Domestic Relations Statutes". As you may know there is a waiting/ separation period the is required before one can obtain a divorce. It is generally 1 year. With a green card only a month away she may not lose it. She should speak with an attorney regarding the effect of divorce proceedings on her green card.
