IN A MUTUAL AGREEMENT FOR DIVORCE, WITH NO PARTY AT FALUT, WHO HAS TO MOVE OUT OF THE HOUSE,UNTIL OUR PROPERTY HAS BEEN DIVIDED?
  ARE BOTH OUR 401K ADDED TOGETHER AND THEN DIVIDED?

Dear Garry,

How assets are divided depends on the state you live in. Use divorcesource.com to learn the divorce laws of your state.

Sometimes divorcing couples live in the same home until the house is sold and the money is divided- this reduces money going into another home/ apt where you have to set up phone and other utilities.

As far as the 410K's you may want to speak with a lawyer or accountant regrading how to best handle this tax purposes.
