Question
My husband moved out of the house 7 years age (we live in California).  He has not paid any of the mortgage, insurance or taxes on the house.  We he moved there was very little if any equity in the house.  Now that there is lots of equity he has filed for divorce and wants to sell the house or force me to buy him out at 50% of the equity.  The mortgage with taxes and insurance is $2500 per month.  Do I have to split the equity with him 50/50

Dear Amelia,

Generally speaking assets aquired during the marriage (including the marital home) are marital assets. However, because of the length of separation time you may be able to convince the judge that he has no rights to it any longer. You should speak with an attorney in your state and have readily available the date of separation, ie- when he moved out.
