Question
My husband and I made the choice to divorce.
We have a 2yr old son together and a new house with mortgage about 2 1/2 months old.  He also has a truck that is half in my name.

We want the easiest settlement and the quickest.

Is there anyway that I can remove my name from the home and loan and the truck, so he can keep them and live in the home?
I have moved out with our child and pet (my choice)

Answer
Dear Amanda,

To remove your name from the home and loan from the truck you will need to review your signed paperwork relating to each. You will also need to speak with the lending institutions about how to sign over these assets.

Consider the value of the home and whether or not you want to receive half of the value- asking that your spouse pay you for your half.

Before you sign any agreement you may each want to have a lawyer review it for accuracy and that you have included any stipulations, ie: visitation, support, paying for the future education of your child, any alimony either of you may be entitled to.

Here are some sites you may want to check out: womansdivorce.com, equalityinmarriage.org, divorcesource.com and aaml.org

I hope this was of some help.
