Answer
Dear Heather,

This is a good question for a divorce/ family lawyer. As you are are essentially married and financially responsible for each other until you are divorced this is questionable area.

While this article is for California it does make some good points on home purchases: http://californiadivorce.info/dm.money.assetsliabilities.keepheadabovewater.htm

Another article worth the read: http://www.legalsurvival.com/legal_faqs/divorce_law.html

Check this article out: http://www.nolo.com/product.cfm/objectID/22C33D51-5D74-474D-A04CF25A3891F381/sam...

Visit divorcesource.com for more information on divorce in your state and perhaps speak with an accountant regarding the timing of your home purchase (what are the tax pro's and con's).

I hope this was helpful.
