I'm not a lawyer, I can't answer any real legal questions, long, involved or very detailed questions. Rather I only what I know about divorce by experience and going through a divorce. I'm familiar with the divorce process and some prodedures. I can answer most any questions about divorce. Question
Since my husband can't use money any more to control.  He uses visiting my son.  When I don't agree with him he finds a way not to see our son.  Now that I didn't agree with him with the settlement.  He wanted to pay the mortgage instead of child support.  That would have gave him too much power.  He now says he can't visit or keep in touch with our son because he has to work.  I use to work two jobs and take care of the mortgage and the house and son when we were married so I can't understand this.  Is there a provision that I can put in the settlement that would give me full legal rights if he continues to behave like this.  My son has to go to the hospital and get tested to see if he has a disease and his father knows but I don't want to have to get his permission if he needs medical because my ex wants to get me back at me.

Hi Joy~

What kind of custody do you have?  It sounds like you have joint physical custody to me.  Meaning that you have primary custody but share jointly in the decisions for your son that include health,schooling decisions,etc.  With this kind of custody both parents make major decisions for the well being of the child(ren).  So technically if you have joint physical custody (since he resides with you full time),and you are the primary caregiver for the child.  You can make decisions w/o your ex husbands approval.  For example~if your son needs immediate tests or treatment of something you have the right to make any decision necessary,and you can override his decision.  Don't let your ex try and run everything just b/c he thinks he can.  I hope this helps answer your question.  If you have any further questions please feel free to ask.
