Divorce Issues - seking money settlement after divorce final
Expert: Equality in Marriage Institute - 1/1/2006
Question I'll try and sum it up simply. I was served papers during a turbulant time and it was final in 20 days (in Idaho) Under duress I signed them and now 5 years later realize that there were many discrepancies and I couldn't find an attorney as they all said they couldn't represent me due to conflict of interest, they dealt with my ex thru Real estate dealings, etc. And so I was taken advantage of and basically got nothing. Nothing even close to fair. I am gravely ill and there's no way I would have agreed to things as they were, but too confused to get any representation. Can I get a proper settlement now? He's a real estate developer now and has assessts. Thank you for any help you can give me.
Answer Dear Felicia,
In order to have a divorce decree modifyied or appealled you will need to take your decree to the appellate court in your state. Appealling a decision can be expensive (visit www.equalityinmarriage.org - When Divorcing section)Most likely you will need an apellate attorney to review your case and see on what grounds you can appeal.
I would recommend that you use google and search under "name of your state + divorce + appeal" and see what lawyers/ information come up.
You may also call your state bar Association and speak with a staff member about a referral or any public information available on the topic.
