Divorce Issues - wanting to divorce, but live in different states

Expert: Equality in Marriage Institute - 11/14/2005

Question
I live in Alabama, and my wife lives in Texas. We've been separated for about a year now. We were married in Texas. What state would i have to file for divorce under?

Answer
Dear Greg,

You file for divorce in the state in which you reside. So, if you want the divorce and you live in Alabama, then you would file in Alabama. It is possible that she can file in Texas also. It may in your best interest to look at the divorce laws  in both states (divorcesource.com) to see what state would be more favorable to the two of you. Check out equalityinmarriage.org and aaml.org for more info on divorce.

I hope this helps.
